These Terms & Conditions ("Terms") govern your access to and use of the ChatterPulse service, websites, and related applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

ChatterPulse is operated by Kim Tech Consultant AB ("Company", "we", "us", or "our").

1. Eligibility & Account

1.1 Eligibility: You must be at least 18 years old and have the legal capacity to enter into these Terms.

1.2 Account Registration: To use the Service, you must create an account and connect your Twitch account through Twitch OAuth. You agree to provide accurate, complete, and current information.

1.3 Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately if you suspect unauthorized use.

1.4 Compliance with Laws: You may use the Service only in compliance with these Terms, Twitch's Terms of Service and Developer Policies, and all applicable laws and regulations.

2. Description of the Service

2.1 Purpose: ChatterPulse is a lightweight analytics and engagement companion for Twitch streamers. It analyzes public Twitch chat messages and chatter data to provide real-time insights, overlays, and post-stream recaps.

2.2 Twitch Integration: The Service uses Twitch APIs and IRC (including, but not limited to, Twitch OAuth, chat messages, and "Get Chatters" endpoints) in accordance with Twitch's rules. We do not expose lurkers or non-chatting viewers.

2.3 Features: Features may include real-time analytics, dashboards, new vs. returning chatter metrics, post-stream recaps, optional overlay notifications, and other tools we may add or modify over time.

2.4 No Guarantee of Availability: We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We do not guarantee that the Service will be available at all times or free from interruptions or errors.

3. Subscription, Fees & Billing

Adjust this section to reflect your actual pricing and billing model.

3.1 Plans: We may offer free trials and paid subscription plans (for example, a "Pro Plan"). Plan details, including features and pricing, are described in the Service or on our website and may change from time to time.

3.2 Free Trial: If you sign up for a trial, your access will automatically end at the end of the trial period unless you convert to a paid plan. We may limit eligibility or duration of free trials at our discretion.

3.3 Billing: Paid subscriptions are billed in advance on a recurring basis (for example, monthly) via our payment processor (such as Stripe). By starting a paid plan, you authorize us and our payment processor to charge your payment method for applicable fees and taxes.

3.4 Price Changes: We may change subscription fees at any time. Price changes will apply to the next billing cycle after we notify you in advance, as required by applicable law. Your continued use of the Service after the price change becomes effective constitutes your acceptance of the new price.

3.5 No Refunds: Except where required by law or explicitly stated otherwise, all fees are non-refundable, including for partial periods or unused features.

3.6 Taxes: You are responsible for any applicable taxes, duties, or other government charges.

4. Your Responsibilities & Acceptable Use

4.1 Lawful Use: You agree not to use the Service in any way that violates any applicable law or regulation, violates Twitch's Terms of Service, community guidelines, or developer policies, or infringes the rights of any third party.

4.2 Prohibited Conduct: You agree not to reverse engineer, decompile, or attempt to extract the source code of the Service; interfere with or disrupt the integrity or performance of the Service; use the Service to harass, abuse, or harm others; attempt to bypass any security or authentication measures; or use the Service to collect or infer sensitive information about individuals in a way that violates Twitch policies or privacy laws.

4.3 Streaming & Disclosures: You are responsible for complying with any applicable regulations about disclosures to your viewers (for example, if you are using analytics or tracking tools). You remain responsible for how you use information from the Service in your stream and community.

5. Data, Privacy & Security

5.1 Data We Access: Through your authorization, we may access your Twitch account identifiers and tokens, public chat messages and chatter information from your channel, and stream metadata and engagement statistics.

5.2 Use of Data: We use this data to provide analytics, dashboards, overlays, and recaps; maintain and improve the Service; and ensure security and prevent abuse.

5.3 Data Retention: We retain data for as long as reasonably necessary to provide the Service and for legitimate business purposes (such as security, troubleshooting, and legal compliance), consistent with our data retention practices as described in our documentation and Privacy Policy.

5.4 Privacy Policy: Our collection and use of personal data is further described in our Privacy Policy, which is incorporated by reference into these Terms. By using the Service, you also agree to our Privacy Policy.

5.5 Security: We implement reasonable technical and organizational measures to protect your data (for example, role-based access, encryption at rest where supported, and short-lived overlay tokens). However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

6. Twitch & Third-Party Services

6.1 Third-Party Services: The Service relies on third-party services such as Twitch, Supabase, hosting providers, and payment processors (for example, Stripe). Your use of these third-party services is subject to their own terms and privacy policies.

6.2 No Affiliation: ChatterPulse is not affiliated with or endorsed by Twitch Interactive, Inc. or any other third party mentioned. All trademarks and logos are the property of their respective owners.

6.3 API Changes: Twitch or other third parties may change their APIs or services, which can impact the functionality of the Service. We are not responsible for interruptions or limitations caused by such changes.

7. Intellectual Property

7.1 Our IP: The Service, including all software, interfaces, graphics, trademarks, logos, and underlying technology, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

7.2 Your Content: You retain any rights you have to your own stream content, branding, and other materials. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and process the data we collect from your connected Twitch account solely for the purpose of providing and improving the Service.

7.3 Feedback: If you provide feedback, ideas, or suggestions, you agree that we may use them without restriction or compensation to you.

8. Disclaimers

8.1 "AS IS" Service: The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

8.2 No Guarantee of Results: We do not guarantee any specific outcomes such as increased viewership, increased engagement, or revenue. Analytics and insights are provided for informational purposes only and may not be error-free or complete.

8.3 No Professional Advice: Any information provided by the Service does not constitute legal, financial, or other professional advice.

9. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or loss of profits, revenue, data, or goodwill arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid to us for the Service in the 1 months preceding the event giving rise to the claim, or (b) SEK 100. Some jurisdictions do not allow the limitation or exclusion of certain damages, so some of the above limitations may not apply to you. In such cases, the limitations will apply to the fullest extent permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Kim Tech Consultant AB, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights (including Twitch's terms and policies or any privacy or intellectual property rights).

11. Termination

11.1 Your Right to Terminate: You may stop using the Service at any time and cancel your subscription according to the instructions provided in your account or billing portal.

11.2 Our Right to Terminate or Suspend: We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, we suspect fraudulent or abusive activity, or continuing to provide the Service to you is no longer commercially or legally viable.

11.3 Effect of Termination: Upon termination, your right to use the Service will cease immediately. Certain provisions of these Terms will survive termination, including those relating to intellectual property, disclaimers, limitation of liability, and indemnification.

12. Changes to the Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page and, where required, provide additional notice (for example, via email or in-app notification). Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service.

13. Governing Law & Dispute Resolution

13.1 Governing Law: These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of Sweden, without regard to its conflict of laws principles.

13.2 Venue: You and we agree to submit to the exclusive jurisdiction of the courts located in Sweden to resolve any dispute arising out of these Terms or the Service, except where applicable law provides otherwise.

13.3 Informal Resolution: Before filing any formal legal claim, you agree to first contact us at kim@kimtech.dev to attempt to resolve the dispute informally.

14. Miscellaneous

14.1 Entire Agreement: These Terms, together with any other policies or agreements referenced (such as our Privacy Policy), constitute the entire agreement between you and us regarding the Service.

14.2 Severability: If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.

14.3 No Waiver: Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

14.4 Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

14.5 Language: If we provide a translation of these Terms, the English language version will control in the event of any conflict, to the extent permitted by law.
